The conflict between the right to honour and reputation and the rights to freedom of expression and access to information has long existed in a state of constant tension. With the digitalisation of communication, infringements of personality rights—such as the rights to honour and reputation—have become increasingly prominent. The widespread development and use of electronic communications, the Internet, social media and blogs have given rise to new forms of civil liability, including those involving cross-border elements. This is one of the most complex legal challenges confronting democratic societies, which are founded upon pluralism, public debate, criticism, tolerance, respect for others and transparency. This volume examines these issues by exploring a number of the legal challenges arising in both domestic law and private international law.
