Maria Miguel Carvalho, PhD integrated researcher at JusGov, has just published by Editora Almedina the Lecture she presented within the scope of her habilitation examination.
In this study she reflects on the need to redimension the boundaries of trademark rights, given the expansionist trend of the legal protection granted to them.
Using the example of trade marks with a reputation and addressing, in particular, the interpretation and application of the rules regarding the infringement of that right, as well as the limits conferred by the registration of this sign, she seeks to determine whether those limits will be sufficient to ensure the desirable balance of the interests involved or whether it will be necessary to go further, expanding the already existing limits and/or using external limits to Trade Mark Law, with which she intends to contribute to the enlightenment of the path followed (or to be followed) by the current European Trade Mark Law.
