The literature has pointed out, in a consensual way, to the consequences that the exposure of children to family violence causes or can cause for their well-being and for their health, namely for their development. It is important to reflect on how the penal norm and its application have (dis) considered the child as a victim of the crime of domestic violence, in situations in which the child witnesses or experiences the acts practiced on the parent. It will also be important to reflect upon parental responsibilities in the context of violence, in particular how they are regulated in cases of domestic violence and what evolution our legal system has been granted in this regard. In addition, it is assumed that it is necessary to understand how the pandemic has enhanced parental conflict, domestic violence and mistreatment of children.
