Synopsis This investigation work has as central objectives to dissect the true field of action and the practical range of the new “Código de Execução das Penas”, demonstrating that it is by itself an incentive to the resocialization, having in mind those which are the purpose of the criminal sanctions: the general prevention, the special prevention and an the possible remedial effect. This study intended to evaluate possible faults and successes of that code, taking into account, that theme wich is the reintegration of the prisioner when he gets his, having the fundamental ultimate intencion to verify, in fact, if the present Code has brought any benefits to that, away from relapsing. That study was made having as basis bibliographic support, the Activities’Report of 2010 presented by all the portuguese prisons and also the help of opinions given by professionals involved in this area. The result of that joint analysis has made the contributions and advantages provided by the “Código de Execução de Penas” known. Beginning with the incentive and stimulus to work, study and participating in professional courses, while recluses serve time in prison, as factors taken into account in the penalty’ flexibility and ending with his insertion on the Nacional Health’s System, we can conclude with the presence of that worry on the Code, where there are garanteed all its basis.
