Synopsis The present dissertation intends to provide the legal-constitutional order with an innovative solution, in particular regarding of recruits and selects process method in within the the public service. One of the main concerns of the present thesis was to show that the solution provided by the law is clearly not enough, regarding the protection provided, as well the guaranties of ordinary citizens, in the recruitment and selects process matters. This way, we tried to devise a solution that is able to avoid frequent problems that arise during the procedure of public tender. This way the judicial effective remedies emerge as requisite as key elements of the present thesis.
