Synopsis The making of an essay/dissertation in the second cycle is more than the result of a research project of masters students where they in-depth knowledge in the area they have chosen. More than that, it covers the special purpose of providing a modest contribution to the legal community. In this vein, it is now proposed the present issue that shows itself as a current and one, especially when we consider the interest and the relevance that booth jurisprudence and doctrine offer to that subject in nowadays. Therefore, it will be stated the central matters which aim to answer with our thesis: can we, and in which conditions, subsume the swaps into the regime of the unexpected circumstances?
