Synopsis The following paper as the purpose to analyze what infertility is and the role of Medically Assisted Procreation as a resolution to human infertility by making the process of procreation simpler when other attempts have failed the desired objective: having a child. This issue of surrogate motherhood will be dealt with a lot of care since that this mechanismis the only way for women that were born without a uterus or that have lost it after a lesion or an illness to become mothers. For these women there is no other way of fulfilling their desire of having a biological child. Surrogate motherhood unravels a great amount of questions regarding to ethic, moral, social and legal and there is no easy solution for this: it goes against many ancestral design but the use of such a institute should not be forbidden because of these problems. Since by not allowing the use of such institutes it may open a window for the people that face all this problems to go to another country where maternal substitution is allowed, with all the costs and risks that come from the procedure, not to mention the difficulty of registering the new born citizen. By using surrogate motherhood it’s a reality that the common legislator needs to be watchfull and giving answers based on the concrete problems that are placed before him.
